These are the terms and conditions for the operation and use of Getagallery.
By subscribing to Getagallery.com or registering as a Subscriber to the
site, you accept these terms and conditions. If you enter into this agreement
on behalf of any other party, that party is also bound by these terms
and conditions.
2. Getagallery is owned and operated by Cre8ology Limited.
3. Cre8ology
Limited reserves the right to refuse subscriptions or request further
information before approving an application.
4. The Subscriber will have
access to the Getagallery functions and facilities on payment of the fees
as notified from time to time. The use of the functions and facilities
is restricted to the Subscriber and is non transferable. The subscription
is for such usage only and confers no rights to the underlying systems.

A Subscription term is for one calendar year and renewal at the end of
that period will take place automatically unless terminated by prior notice
and provided the relevant fee has been paid. The fee structure for renewal
will be communicated during the final month of the contract period and
the Subscription will be immediately terminated if the applicable fees
are not paid. Current fees are displayed on the Getagallery site and are
subject to change from time to time.
6. The Subscriber is wholly responsible
for the content of its site and shall not use the service for any purpose
prohibited by any relevant law or regulation. The Subscriber is also wholly
responsible for ensuring that the content does not infringe any copyright,
ownership, or any other intellectual property or privacy rights and agrees
to indemnify Cre8ology Limited for all and any costs, fines or damages
it may incur as a result of any infringement of this clause.
7. Cre8ology
Limited reserves the right in its absolute discretion and without prior
notice to suspend, delete or modify any gallery page if the content is
deemed inappropriate or is in breach of clause 6 above or the relevant
subscription has not been paid, and shall not be liable for any consequences
of such action. If a gallery is deleted, the sole liability of Cre8ology
Limited will be to refund the unused whole months’ rental
paid, less a £35 administration fee.
8. Getagallery enjoys excellent
technical quality and uptime. Cre8ology Limited will strive to ensure
that any technical difficulties on the Getagallery site are minimal and
that galleries have maximum uptime. In the unlikely event of a technical
problem, Cre8ology Limited will strive to rectify the problem efficiently
and responsively. Cre8ology Limited will not be responsible for compensation
in the event of any down time of the Site, the Subscriber's site being
dysfunctional or the loss of any information or images from the Subscriber's
site.
9. A Subscriber’s site may include links
to Getagallery providing those links do not portray Cre8ology Limited
or Getagallery in a negative or false manner.
10. Subscription fees are
non refundable if the service is not used for any reason or terminated
before the due time.
11. These terms and conditions were posted on 11th
November 2005. Cre8ology Limited reserves the right to amend the Getagallery
site, policies, fees and these terms and conditions at any time without
prior notice.
12. This agreement shall be subject to the laws of England.
